German chemical giant BASF is taking the European Commission to court due to what it regards as legally unjustified delays over granting market approval for a GM potato.

BASF has argued that the Amflora potato is a "safe and environmentally friendly product".

Amflora potatos are modified to have additional starch, useful in paper, adhesive and textile production as well as food.

BASF now claims that by waiting more than 12 years for a Brussels authorisation, its EU commercial rights are being infringed. It has asked the European Court of Justice's Court of First Instance to order Brussels to make a decision.
