NutraSweet, and fellow aspartame producer from Japan, Ajinomoto Co., Inc., have lost an appeal against a European Court of First Instance ruling, which should bring to an end an 11 year legal battle over EU anti-dumping actions. The senior European Court of Justice has dismissed claims that its junior court erred in law in supporting the EU Council of Ministers, which in 1991 imposed anti-dumping duties on sweeteners imported into Europe. The companies had claimed that the court should have given NutraSweet extra leeway because it had held a patent for US sales when the EU was deciding whether dumping had taken place. The ECJ disagreed and ordered the companies to meet their own costs.
