A UK dairy company should be allowed to continue using the image of a freisian cowhide as a European Union trademark, the European Court of Justice (ECJ) Court of First Instance has ruled.

It said Glasgow-based Robert Wiseman & Sons’s mark was sufficiently distinctive to command EU-wide rights. The court rejected arguments by Belgian dairy company Inex SA, that its established mark, also of cowhide – but including grass and a barn – would be confused with the Scottish packaging.
