Danone has reportedly taken Chobani to court again in the US, accusing its rival of misleading information on serving sizes.

According to multiple media reports, Danone alleges Chobani is incorrectly marketing how much protein the US group’s yogurt contains.

Just Food has approached Danone and Chobani for comment.

The lawsuit, filed in New York, claims Chobani has presented a serving size so it shows the product has a comparable amount of protein to Danone’s Oikos Pro.

“This conduct is particularly insidious when Chobani knows that healthcare providers and ​the federal government are directing the public to choose foods that offer ⁠higher concentrations of protein to maintain their health,” Danone was quoted as saying by Reuters.

The suit comes amid growing consumer interest in protein, with food companies across product areas, not only dairy, touting the amount of the nutrient in their ranges.

According to reports, Danone’s suit highlights the serving size listed on Chobani’s namesake 20G Protein product. Danone alleges Chobani states a serving size of 6.7 ounces to make a claim of 20g of protein a serving. The industry standard, the French group says, is 5.3 ounces.

Last year, Danone embarked on legal action in the US against Chobani over the packaging and marketing of the companies’ cold-brew coffee products.

The lawsuit, filed in New York, alleges Chobani’s La Colombe cold brew used packaging and a slogan “strikingly similar” to Danone’s Stok coffee. 

According to the filing, Chobani’s product allegedly mimicked Danone’s “Bright & Mellow” slogan.  

Danone said Chobani’s infringement of its intellectual property rights had been “knowing, calculated, and systematic”.
