According to reports in the UK and Germany, Ferrero, which owns the Kinder Surprise brand, has lost its monopoly over the name after a German court ruled the word “Kinder” could be used by other confectionery firms.


German confectioner Zott triumphed in its battle to use “Kinder” on its products. According to a report in The Guardian newspaper, the court ruled Ferrero could only protect the design of its products and not have sole use over the “kinder” name.


Officials at Ferrero and Zott could not be reached for immediate comment as just-food went to press.
