Kraft Canada has reached an agreement with food distributor Euro-Excellence that should spell an end to grey market imports of Cote d’Or chocolates.

Euro-Excellence has signed a ‘consent to judgement’ agreeing not to sell or import Cote d’Or chocolates in packaging bearing copyright work owned by Kraft without its consent.


The deal brings to an end a long-running legal battle between the companies.


“For over 100 years, Kraft has earned consumer trust by offering quality products at a good value, and marketing them responsibly. This case was about protecting that trust,” a spokesperson for Kraft Canada told just-food.


“We comply with all Canadian regulatory requirements that include health, safety and language issues, as well as advertising and product promotions. [However] Kraft has no control over these grey market imports,” the spokesperson explained.

Kraft Canada and Euro-Excellence have also signed a distribution agreement for the latter to distribute Cote d’Or chocolates on Kraft Canada’s behalf in Quebec.


“We believe this is a ‘win-win’ situation for everyone and are pleased that Kraft Canada and Euro-Excellence were able to work constructively and collaboratively to resolve this matter. We look forward to a successful business arrangement,” the spokesperson said.
