Chocolate maker Mars Inc has lost a case to protect its Twix trademark in the Czech Republic.

The country’s Supreme Court rejected a complaint from the confectioner that a Turkish product on sale in the Central European country, called Twingo, resembles its trademarked Twix in shape and overall appearance. Mars also argued that the name Twingo is very similar to Twix.

Twingo is manufactured by Turkish chocolate maker Solen Cikolata.

The court, however, concluded that the two products are sufficiently discernible from each other. The average customer, according to the judges, is an observant and careful one.

A spokesperson for Mars in the Czech Republic declined to tell comment on whether the group will appeal the decision. “In the highly competitive environment of brand products, such complaints are part of everyday business,” she told just-food.
