Law firms Paliare Roland Rosenberg Rothstein and Koskie Minsky have filed a class action lawsuit against supermarket group Loblaw on behalf of consumers potentially exposed to the Hepatitis A virus at a Loblaw store in western Toronto.

The discovery of the virus in a store employee last month led to the store’s temporary closure. Many customers sought vaccination, fearing that they could have been contaminated.
In a press release, the firms explained: “Matthew Vezina, the proposed representative plaintiff, is seeking compensation from Loblaws on behalf of all persons who may have been exposed to the Hepatitis A virus as a result of coming into contact with the allegedly contaminated produce or who may have been exposed to the Hepatitis A virus as a result of coming into contact with persons who were infected by the allegedly contaminated produce.”
The Statement of Claim, filed in the Ontario Superior Court of Justice in Toronto, asks for unspecified compensation. The law firms say that it must cover the alleged injuries of people who “may have contracted the Hepatitis A virus, were forced to discard produce, incurred out-of-pocket expenses, suffered mental distress and spent time and money seeking medical treatment”.
