The court said the “refusal to pay interest… constitutes an actionable measure”, effectively backing an earlier ruling. However, judges also formally set aside that previous ECJ Court of First Instance judgement, meaning Greencore may need further legal action to recoup its money.


Greencore wants Brussels to pay interest on €916,674 repaid after the ECJ’s Court of First Instance reduced a competition fine imposed by Brussels in 1997.
