The Australian Federal Court court will decide by Tuesday (19 September) whether it will grant an injunction to delay Metcash’s proposed acquisition of fellow retailer Franklins.
Last month, the Australian Competition and Consumer Commission (ACCC) appealed against a ruling that had dismissed its earlier move to block the deal and cleared Metcash to buy Franklins.
The competition watchdog claimed the court made a number of “significant legal and factual errors” when it dismissed its application, which it opposes on competition and legal grounds.
