US-owned Arnott’s Biscuits has reached an out-of-court settlement regarding a range of biscuits sold under the Dick Smith food label that Arnott’s claimed infringes on its Tim Tam trademark.


Dick Smith, owner of the food label which sells the Temptin’ range of biscuits, said Arnott’s had threatened to sue biscuit makers Southern Sky Foods and Paradise Foods because the company considered the packaging of Temptin’ biscuits to be too similar to Tim Tam’s packaging.


On the packaging of Temptin’ biscuits the letter p was in a different font so that the “Tem” and “tin” appeared to be two separate words, packaging which is, according to Arnott’s, an infringement on the Tim Tam trademark.


Under the terms of the settlement, the packaging will be changed so that the name Temptin’ is displayed as one word, with the letter p matching the rest of the word.


Arnott’s Biscuits general manager Peter West said the company was delighted with the outcome, reported the Australian Associated Press.
