Nabisco has won its court battle aimed at securing permission to register the brand name ‘Teddy Graham’ in Brazil. The unanimous court ruling overruled a previous decision by the National Institute of Industrial Property (INPI) that denied Nabisco’s brand name request.

Nabisco successfully argued that its product does not duplicate or resemble the one which was previously registered. The company is expected to promptly resubmit its application to the INPI in order to officially register the “Teddy Graham” name. In explaining the verdict, federal judge Maria Helena Cisne Cid stated that Nabisco’s product does not compete with the previously registered product and will not confuse consumers.
