UK cheese maker Bowland Dairy Products has failed to secure damages from the European Commission in a dispute over the safety of its dairy products.

In 2006, the European Commission critical note on the European Union food safety information network RASFF, warned of problems with Bowland products.


In the damages claim, Bowland argued the Commission had erred when it failed to circulate a decision by the UK Food Safety Authority (FSA) that its curd cheese was safe, following an audit of its Lancashire premises.


The FSA has found improvements to anti-biotic screening systems, the subject of an earlier critical RASFF note. The food watchdog wanted its positive assessment circulated on RASFF too, but the Commission wanted to add its disagreement.


The court “dismissed as inadmissible” Bowland’s case, saying the Commission could express an opinion and the FSA could have ignored them in another RASFF note.
