An attempt at the European Court of Justice (ECJ) to halt the centralisation of marketing Jersey potatoes looks likely to fail because European law cannot prevent sales restrictions within individual European Union (EU) member states.

ECJ advocate general Philippe Léger has advised the States of Jersey can insist local potato sales to the UK, neighbouring Guernsey and the Isle of Man be funnelled through the Jersey Potato Export Marketing Board.


The Jersey Produce Marketing Organisation Ltd claims this breaks EU freedom of trade rules. But Léger said they stop trade restrictions between member states, not within them, adding autonomous Jersey, Guernsey, the Isle of Man and Britain are one EU country.
