The European Court of Justice has ruled Delta Protypos Viomichania Galaktos, of Greece, cannot register as an EU trademark its “Milko” sign, written in western Latin and Greek alphabets, for “milk with cocoa” products, following opposition from Kraft Foods.


Switzerland-based Kraft Foods Schweiz Holding argued that Milko could be confused with its established Milka trademark, for milk, chocolate, cocoa, bakery, sugar, ices and other products.


Delta said the Greek lettering and narrow product range would distinguish its mark.


The court disagreed, ruling: “There is a likelihood of confusion.”
