A trio of French organic production associations has lost an appeal at the European Court of Justice, where they were seeking to overturn part of an EU labelling regulation, which they claimed allowed rivals to market products with a ‘bio’ prefix, even if they were not strictly organic.

The Fédération Nationale d’Agriculture Biologique des Régions de France, (FNAB), the Syndicat Européen des Transformateurs et Distributeurs de Produits de l’Agriculture Biologique, (Setrab), and Est Distribution Biogam Sàrl, (Biogam), were seeking to overturn a European Court of First Instance ruling against their case.
The organisations claimed that the regulation “makes it possible to lure customers away from organic products,” but their claims that the junior ECJ court had erred in procedure were dismissed.
