The US firm said a Dusseldorf court had ruled in its favour over a patent infringement suit against three companies, Lonza, Celanese Ventures and Nutrinova Nutrition Specialties & Food Ingredients.


Martek, which sells DHA products for use in functional foods, said its patent on to microbial oils containing at least 35% DHA had been infringed.


The ruling in Germany follows a US judgment last year that found Lonza had infringed three U.S. Martek patents in functional foods.


Martek CEO Steve Dubin said: “The decision further demonstrates both the company’s resolve to vigorously defend its intellectual property portfolio and the strength of Martek’s patent portfolio in the marketplace.”
