Kraft Food Global Brands, the US snack subsidiary of Mondelez International, has filed a lawsuit alleging that Kellogg has infringed a patent protecting packaging used in its resealable cookies.
The suit, filed yesterday (16 January) with the Illinois district court, alleges that Kellogg broke a 2003 patent for Kraft Food Global Brand’s “Resealable Food Container”, commonly known as “Snack n Seal” technology. According to the filing, Kellogg used this technology for its Keebler and Sandie cookies.

“Global Brands possesses all rights of recovery under the… patent, including the right to recover damages for past infringement,” the lawsuit states.
Kraft Food Global Brands called for “permanent injunctions” barring Kellogg’s use of the resealable technology and damages.
Kellogg and Mondelez were not available for comment at time of press.
