US restaurant chain Applebee’s International has filed a lawsuit against Nestlé, accusing the Swiss food giant of infringing on its “Skillet Sensations” trademark.

Kansas-based Applebee’s claims that Nestlé, through its Stouffer Corp subsidiary, has used the name in advertising, marketing and packaging, reported the Associated Press.

The lawsuit alleges that Nestlé’s use of the name causes “a likelihood of consumer confusion, deception and mistake,” because both companies’ Skillet Sensations products are aimed at a similar market.

Last month, the US Trademark Trial and Appeal board found in favour of Applebee’s, but does not have the power to control the use of a trademark, AP said.
