Governor Jeb Bush signed the measure (SB 1832) in Tuesday following pressure form a legislator and attorney defending Publix supermarkets in a Charlotte County lawsuit. Attorneys are concerned that the bill smoothes the way for further litigation restricting injured shoppers’ rights to claim compensation. It could lead grocery stores to withdraw the facility, leaving disabled and elderly shoppers at a disadvantage.
The bill signed by Bush says a shopping cart is not dangerous and that a grocery store can only be sued when one causes an injury if there is proof of negligence.
