Pennsylvania retailer Phuong Van Nguyen, who operates under the Souderton Oriental Food Market name, entered into a consent agreement in federal courts on 18 October 2001, as a result of several violations of the Federal Meat Inspection Act and the Poultry Products Inspection Act, the USDA’s Food Safety and Inspection Service (FSIS) announced today [Tuesday].


The defendant acknowledged purchasing unlabelled and uninspected meat products from unknown suppliers on many occasions, and then selling the products to his retail customers.


Under terms of the agreement with the USDA, Phuong Van Nguyen is prohibited from selling, transporting, receiving or offering for sale, any uninspected or misbranded meat or poultry products. He must also maintain accurate records at his market for each product he buys or sells that show the source of the meat, meat product, poultry or poultry product. These records must be made fully accessible to authorised FSIS officials.


If any of the conditions of the agreement are violated, the defendant would pay for the first violation a fine of US$100 per pound for violative product, and US$500 per pound for any other violation. Van Nguyen would also be required to pay court costs, attorney fees and all expenses incurred by FSIS officials.
