The lawsuit filed by Worldwide Restaurant Concepts against its meat supplier Excel Corp has been thrown out by a judge.

WRC filed the suit two years ago after an outbreak of the deadly bacteria E. coli O157:H7 caused the death a child and sickened 60 other patrons in its Sizzler brand Milwaukee restaurant.
The court’s explanation for dismissing the case was not discussed in WRC’s statement to the Security and Exchange Commission (SEC). The statement said that the judge dismissed “all claims against Excel, including those filed by the company and the plaintiffs”.
WRC said it would appeal the ruling.
