Any residents in the Chicago-area purchased milk from Dominick’s Finer Foods or Jewel food stores between 23 August 1996, and 23 August 2000 can join a price-fixing lawsuit against the grocery chains, according to a ruling by a Cook County judge.

Oak Brook-based Dominick’s, a subsidiary of Safeway Inc, and Albertson’s Jewel deny that they illegally conspired to fix milk prices about US$1 higher than in other parts of the US. They have stated that the case should not be heard in court.
Scheduled to start on 15 January 2003, however, the trial will now potentially involve more than 5 million plaintiffs, after Circuit Court Judge Timothy Evans certified the class of plaintiffs on Tuesday.
Jay Rock, an attorney with Rock Fusco & Garvey, which is representing the litigants, explained that the case could be one of the largest in Illinois history.
