The Irish Competition Authority has indicated that it will appeal the High Court decision to allow Kerry Group to complete its EUR165m (US$225m) acquisition of Breeo Foods.

“Our position remains that the acquisition would lessen competition in the market for rashers, non-poultry cooked meats and cheese. We will be taking our appeal to the  Supreme Court,” a spokesperson for the watchdog told just-food.


Last month, the High Court quashed the Competition Authority’s decision to stop Kerry buying Breeo Foods from Reox Holdings.


If the deal proceeds, it would see Kerry take ownership of a number of household brands, including Dairygold, Galtee, Shaws, Roscrea, Mitchelstown and Calvita.


In a statement released yesterday (7 April) evening, Kerry said that it would defend its position and resist the appeal. The company was not immediately available for further comment.
