The United States District Court for the Northern District of California recently ruled that Imagine Foods, producers of best selling natural foods products, are absolved of a packaging infringement claim brought against it by Amy’s Kitchen, a competitor.
Amy’s Kitchen, the plaintiff, initially sought a temporary restraining order prohibiting Imagine Foods from shipping, distributing or selling any of its Imagine Natural® Stuffed Sandwich products in its new package. Amy’s claimed that distribution should not be permitted, asserting that the Imagine package was using a package design and image Amy’s felt was proprietary to their company. Judge Martin Jenkins of the US District Court of San Francisco denied Amy’s the temporary restraining order and ultimately granted Imagine Foods motion for summary judgement, thereby dismissing the case. Imagine has been awarded its court costs.

Imagine Foods first introduced its Veggie Pocket sandwiches in 1989, and sold 27 million stuffed sandwiches over the next nine years. Imagine Foods asserted that Amy’s request for a temporary restraining order was unwarranted since Imagine had used a similar image in marketing and advertising years before Amy’s even had a product on the market.

We feel vindicated that the courts ruled in our favor at every stage of the proceedings. We look forward to returning our focus to where it belongs — making great-tasting, high quality natural foods,” said Robert Nissenbaum, Imagine Foods’ president and founder.
