An appeals body at the World Trade Organization has ruled India's ban on US poultry products did break trade rules.

The WTO's Appellate Body upheld the organisation's ruling in October that India had breached regulations for blocking shipments of poultry meat and chicken eggs from the US in 2007 due to concerns over avian influenza.

India had questioned the ruling but the appeal was largely thrown out. The Appellate Body said India's measures "arbitrarily or unjustifiably discriminate" against the US.

It said India's measures are not "based on" nor "conform to" relevant international standards.

Tom Vilsack, the US Secretary of Agriculture, said the dismissal of the appeal represented "a major win for US agriculture and, in particular, the US poultry industry".

Vilsack said: "Today, America's poultry producers are being challenged again by an outbreak of highly pathogenic avian influenza, and this decision serves to encourage USDA's efforts to maintain open markets for US poultry based on international standards. A rules-based international trading system is critical to allow US farmers and ranchers to compete on a level playing field worldwide."
