Robert Wiseman Dairies today (24 October) confirmed that Arla Foods UK and its subsidiary Claymore Dairies Limited are bringing a court action against the company. The move comes from alleged losses and damages sustained by their Scottish operations.

The writ, the details of which Robert Wiseman says are unsubstantiated, seeks damages of GBP15m (US$28m). The action is on a joint and several basis against Wiseman and the other parties who are subject to the Statement of Objections announced by the Office of Fair Trading on September 6.

In September, the OFT said that it had provisionally found Robert Wiseman, Ballantyne, Grahams, Quothquan, Renfrew and Scottish Milk Dairies were involved in concerted practice in the supply of fresh processed milk to ‘middle ground’ customers in Scotland – schools, shops, cafes and hotels – from 2000 to 2003.

Robert Wiseman responded to the OFT’s acusations by stating that it would vigorously defend its position. Today, the company confirmed that it would do likewise against what it described as “a frivolous claim”.
